This Travel Services Agreement explains how we’ll work together and outlines the responsibilities of both HEY HEY VACAY TRAVEL CONSULTANTS, LLC and our valued travelers. While it contains important legal information, it is also intended to ensure clear communication and set expectations so your travel planning experience is as smooth and enjoyable as possible.

Important Traveler Acknowledgements

Thank you for choosing HEY HEY VACAY TRAVEL CONSULTANTS, LLC!

Our goal is to make your vacation as enjoyable and stress-free as possible. Before we begin making your travel arrangements, please review the important information below. These acknowledgements summarize some of the most important responsibilities of both you and HEY HEY VACAY TRAVEL CONSULTANTS, LLC.

Please read each item carefully.

Traveler Responsibilities

☐ Reservation Accuracy
I understand it is my responsibility to review all confirmations, invoices, itineraries, and travel documents immediately upon receipt and notify HEY HEY VACAY TRAVEL CONSULTANTS, LLC of any errors or discrepancies.

☐ Legal Name Requirement
I understand my name on all reservations must exactly match the government-issued identification I will use while traveling.

☐ REAL ID & Identification
I understand that I am responsible for obtaining and carrying acceptable identification for travel, including a REAL ID-compliant driver’s license or other TSA-approved identification for domestic U.S. air travel when required.

☐ Passports, Visas & Travel Documents
I understand I am solely responsible for obtaining and maintaining all required passports, visas, electronic travel authorizations (ESTA, ETA, ETIAS, etc.), vaccination records, and any other required travel documentation.

☐ Entry Requirements & Criminal Record Restrictions
I understand each country determines its own entry requirements. Some countries, including Canada, may deny entry based on criminal history. I am solely responsible for determining whether I am legally eligible to enter every destination on my itinerary.

☐ Health Requirements
I understand I am responsible for meeting all vaccination, medical, health, and entry requirements for my destination(s).

☐ Travel Insurance
I understand that HEY HEY VACAY TRAVEL CONSULTANTS, LLC has recommended comprehensive travel insurance, and I have been given the opportunity to purchase coverage.

☐ Supplier Terms & Conditions
I understand my reservations are subject to the cancellation policies, refund rules, pricing, schedules, and other terms established by each travel supplier.

☐ Professional Service Fees
I understand that HEY HEY VACAY TRAVEL CONSULTANTS, LLC reserves the right to charge professional service fees for certain services as outlined in the Travel Services Agreement.

☐ Communication Responsibilities
I understand I am responsible for monitoring my email, voicemail, and other communications, responding promptly to requests, and meeting all supplier deadlines.

☐ Contact My Advisor First
I understand that if changes or problems arise, I should contact HEY HEY VACAY TRAVEL CONSULTANTS, LLC before contacting airlines, cruise lines, hotels, tour operators, or other suppliers directly whenever possible.

☐ Travel Changes
I understand that travel suppliers may change schedules, itineraries, pricing, ports of call, accommodations, aircraft, ships, or other travel arrangements before or during my trip.

☐ Force Majeure Events
I understand travel may be impacted by weather, natural disasters, labor strikes, political unrest, pandemics, supplier insolvency, government actions, or other events beyond the control of HEY HEY VACAY TRAVEL CONSULTANTS, LLC.

☐ Travel Advisor Authority
I authorize HEY HEY VACAY TRAVEL CONSULTANTS, LLC to make reasonable, good-faith decisions on my behalf during time-sensitive travel disruptions when immediate action is necessary and I cannot be reached after reasonable attempts.

☐ Acceptance of Terms
I acknowledge that I have received, read, understand, and agree to the complete Travel Services Agreement and Terms & Conditions provided by HEY HEY VACAY TRAVEL CONSULTANTS, LLC.

Our Professional Services

HEY HEY VACAY TRAVEL CONSULTANTS, LLC is a full-service professional travel agency dedicated to creating exceptional travel experiences for our clients. We proudly serve travelers throughout the United States and specialize in planning vacations and business travel around the world.

Our services include, but are not limited to:

Our role extends well beyond making reservations. We provide professional consultation, destination expertise, supplier recommendations, itinerary design, travel research, documentation guidance, and ongoing support before, during, and after your travels.

As your travel advisor, we advocate on your behalf whenever possible and strive to provide the highest level of personalized service throughout your travel experience.

Professional Service Fees

While HEY HEY VACAY TRAVEL CONSULTANTS, LLC is compensated by commissions paid by many travel suppliers, certain services require significant professional time, expertise, research, and administrative work for which suppliers provide little or no compensation.

Accordingly, HEY HEY VACAY TRAVEL CONSULTANTS, LLC reserves the right to charge professional service fees for certain services. These fees help offset the professional time and expertise required to provide exceptional travel planning and ongoing client support.

Professional service fees are separate from any supplier-imposed cancellation penalties, airline fees, cruise line fees, hotel penalties, insurance charges, or other costs assessed by travel suppliers.

Whenever reasonably possible, applicable fees will be disclosed before services are performed. However, certain urgent travel situations may require immediate action on your behalf.

Unless otherwise agreed in writing, all professional service fees become earned and non-refundable once the requested service has been performed, regardless of whether the travel ultimately takes place.

HEY HEY VACAY TRAVEL CONSULTANTS, LLC reserves the right to modify, waive, reduce, increase, or eliminate professional service fees at any time without prior notice. The fee schedule in effect when services are requested shall apply.

Working Together

Our clients receive the greatest value when we work together as partners throughout the travel planning process.

To provide the highest level of service, we ask that you:

Share your travel goals, interests, budget, and expectations.
Inform us of any special needs, accessibility requirements, dietary restrictions, or medical concerns that may affect your travel.
Share any travel research or pricing you have already received.
Communicate changes in your plans as soon as possible.
Allow us the opportunity to complete the travel arrangements we have researched and recommended.

You are responsible for providing complete, accurate, and timely traveler information, including but not limited to:

Legal names exactly as they appear on government-issued identification.
Dates of birth.
Contact information.
Passport information (when applicable).
Known Traveler Numbers (TSA PreCheck, Global Entry, NEXUS, etc.), if applicable.
Emergency contact information.
Any other information required by travel suppliers to complete your reservations.

You understand that inaccurate, incomplete, or untimely information may result in denied boarding, denied entry, supplier-imposed fees, reservation cancellations, travel delays, additional expenses, or other travel disruptions.

HEY HEY VACAY TRAVEL CONSULTANTS, LLC shall not be responsible for any costs, losses, delays, penalties, or travel interruptions resulting from inaccurate, incomplete, or late information provided by you or by anyone traveling under your reservation.

Because our compensation is generally earned only when reservations are booked through our agency, we respectfully request that clients do not independently book portions of their itinerary after requesting our professional planning services.

Open communication allows us to provide the best recommendations, identify promotions, resolve issues efficiently, and advocate on your behalf throughout your journey. By working together and maintaining timely communication, we can help ensure your travel experience is as smooth and enjoyable as possible.

Client-Initiated Supplier Contact

One of the greatest advantages of working with HEY HEY VACAY TRAVEL CONSULTANTS, LLC is having a dedicated travel professional available to advocate for you before, during, and after your trip.

Whenever possible, we ask that you contact HEY HEY VACAY TRAVEL CONSULTANTS, LLC before contacting any airline, cruise line, hotel, tour operator, insurance provider, online travel agency, or other travel supplier directly regarding your reservation.

If you choose to contact a supplier directly, you acknowledge and understand that:

The supplier may modify or cancel your reservation without notifying HEY HEY VACAY TRAVEL CONSULTANTS, LLC.
Promotional pricing, onboard credits, amenities, group benefits, discounts, or agency-exclusive offers may be lost.
Supplier representatives may not have access to the same promotions, negotiated rates, or travel options available through HEY HEY VACAY TRAVEL CONSULTANTS, LLC.
Direct changes may require us to spend additional time researching, correcting, rebuilding, or coordinating your reservation.
Changes made directly with suppliers may affect commissions that support the ongoing professional services we provide.

If you request that HEY HEY VACAY TRAVEL CONSULTANTS, LLC restore, rebuild, research, or correct reservations that were modified by you or another party without our involvement, HEY HEY VACAY TRAVEL CONSULTANTS, LLC reserves the right to charge applicable Professional Service Fees as outlined in this Agreement.

While we will always make reasonable efforts to assist our clients, we cannot guarantee that pricing, promotions, reservations, group amenities, or supplier benefits can be restored once changes have been made directly with a supplier.

Agency Relationship

HEY HEY VACAY TRAVEL CONSULTANTS, LLC acts solely as an independent travel agency and as an agent for the airlines, cruise lines, hotels, resorts, tour operators, transportation providers, travel insurance companies, excursion providers, and other travel suppliers that provide your travel services.

We do not own, operate, manage, control, or supervise any airline, cruise line, hotel, resort, tour operator, transportation company, or other travel supplier.

Each supplier is solely responsible for providing the services purchased.

By authorizing HEY HEY VACAY TRAVEL CONSULTANTS, LLC to arrange travel on your behalf, you acknowledge that each supplier is an independent entity with its own terms, conditions, policies, operating procedures, pricing, schedules, and cancellation rules.

Accordingly, HEY HEY VACAY TRAVEL CONSULTANTS, LLC shall not be responsible for any act, omission, negligence, error, accident, injury, property loss, delay, inconvenience, cancellation, bankruptcy, financial default, overbooking, schedule change, labor dispute, mechanical failure, or other occurrence arising from the actions or inactions of any travel supplier.

By authorizing HEY HEY VACAY TRAVEL CONSULTANTS, LLC to make reservations on your behalf, you agree to comply with the terms and conditions of every travel supplier included in your itinerary.

Supplier policies may change without notice and may affect pricing, itineraries, schedules, accommodations, transportation, onboard services, ports of call, excursions, baggage allowances, or other travel arrangements.

You understand that HEY HEY VACAY TRAVEL CONSULTANTS, LLC cannot waive, modify, or override supplier policies and cannot guarantee refunds, credits, exceptions, or accommodations beyond what the supplier is willing to provide.

We will always advocate for our clients and make reasonable efforts to assist in resolving supplier-related issues; however, all final decisions regarding reservations, refunds, compensation, and travel arrangements remain the responsibility of the individual travel supplier.

Travel Risks

Travel involves inherent risks that are beyond the control of HEY HEY VACAY TRAVEL CONSULTANTS, LLC. By traveling, you voluntarily assume these risks and acknowledge that travel conditions may change before or during your trip.

These risks may include, but are not limited to:

Weather events and natural disasters
Disease outbreaks, epidemics, or pandemics
Political unrest, civil disturbances, or acts of terrorism
Government travel advisories or restrictions
Labor strikes or transportation disruptions
Mechanical failures
Airline schedule changes or cancellations
Supplier insolvency or financial default
Delays, missed connections, or itinerary changes
Crime, theft, or personal injury
Border closures or immigration actions
Other unforeseen events beyond the control of HEY HEY VACAY TRAVEL CONSULTANTS, LLC or your travel suppliers

You understand that travel suppliers, governments, and other third parties may modify or cancel travel services with little or no advance notice.

Because every traveler’s circumstances and tolerance for risk are different, HEY HEY VACAY TRAVEL CONSULTANTS, LLC cannot determine whether travel to any destination is appropriate or advisable. We encourage you to make informed travel decisions by reviewing information from reliable sources, including:

By proceeding with your travel arrangements, you acknowledge that you understand and voluntarily accept the inherent risks associated with travel.

Force Majeure

HEY HEY VACAY TRAVEL CONSULTANTS, LLC shall not be liable for any injury, loss, damage, delay, cancellation, additional expense, or other disruption resulting from events beyond our reasonable control (“Force Majeure Events”).

Force Majeure Events include, but are not limited to:

Acts of God
Hurricanes, tornadoes, floods, earthquakes, wildfires, or other natural disasters
Epidemics, pandemics, or public health emergencies
War or military conflict
Terrorism or threats of terrorism
Civil unrest, riots, or political instability
Government actions, travel restrictions, border closures, or quarantine requirements
Airline, cruise line, hotel, or other supplier insolvency or financial default
Labor strikes or transportation disruptions
Mechanical failures
Utility outages
Cybersecurity incidents affecting travel suppliers
Any other event beyond the reasonable control of HEY HEY VACAY TRAVEL CONSULTANTS, LLC

In the event of a Force Majeure Event, your rights regarding refunds, future travel credits, itinerary changes, or cancellations shall be governed solely by the terms and conditions of the applicable travel supplier and any travel insurance policy you have purchased.

HEY HEY VACAY TRAVEL CONSULTANTS, LLC will make reasonable efforts to assist you in working with suppliers during such events but cannot guarantee refunds, future travel credits, alternative travel arrangements, or compensation.

Travel Documents

You are responsible for carefully reviewing all travel confirmations, invoices, itineraries, tickets, and travel documents immediately upon receipt.

Please verify the accuracy of all information, including but not limited to:

Traveler names
Dates of birth
Travel dates
Destinations
Airline flights and schedules
Hotels and accommodations
Cruise reservations
Tour details
Cabin or room categories
Pricing
Special requests

You agree to notify HEY HEY VACAY TRAVEL CONSULTANTS, LLC immediately if you discover any errors or discrepancies.

Failure to promptly review your travel documents may limit available correction options and may result in supplier penalties, additional costs, or travel disruptions for which HEY HEY VACAY TRAVEL CONSULTANTS, LLC shall not be responsible.

Pricing, Quotes, Deposits & Supplier Changes

Travel pricing is dynamic and subject to change until reservations have been confirmed and any required deposits have been received and accepted by the travel supplier.

All quotes provided by HEY HEY VACAY TRAVEL CONSULTANTS, LLC are estimates based on pricing, availability, exchange rates, taxes, fees, and supplier information available at the time the quote is prepared. Quotes are not guaranteed until your reservation has been confirmed and any required deposit has been received and accepted by the applicable travel supplier.

Prices may increase or availability may change at any time prior to confirmation due to factors outside the control of HEY HEY VACAY TRAVEL CONSULTANTS, LLC, including changes made by travel suppliers.

After booking, travel suppliers may lawfully impose additional charges including, but not limited to:

Government taxes and fees
Fuel surcharges
Port charges
Airline-imposed fees
Currency exchange adjustments
Supplier administrative fees
Security fees
Other mandatory charges

You understand that HEY HEY VACAY TRAVEL CONSULTANTS, LLC has no control over supplier pricing, availability, or mandatory post-booking charges.

If a travel supplier lawfully imposes mandatory charges after your booking, you agree to pay those charges in order to maintain your reservation.

Whenever reasonably possible, HEY HEY VACAY TRAVEL CONSULTANTS, LLC will notify you before collecting additional supplier-imposed charges.

Failure to make required deposits or final payments by supplier deadlines may result in cancellation of your reservation, loss of promotional pricing or amenities, forfeiture of deposits, and the assessment of supplier penalties. HEY HEY VACAY TRAVEL CONSULTANTS, LLC shall not be responsible for any losses resulting from missed payment deadlines.

Payment Authorization

By providing your credit card, debit card, ACH authorization, check, or other form of payment, you authorize HEY HEY VACAY TRAVEL CONSULTANTS, LLC to process payments that you have approved for travel reservations, supplier deposits, final payments, approved professional service fees, and other charges authorized under this Agreement.

You certify that you are an authorized user of the payment method provided and authorize HEY HEY VACAY TRAVEL CONSULTANTS, LLC to transmit payment information to travel suppliers, secure payment processors, or other authorized vendors as necessary to complete your travel arrangements.

Whenever possible, HEY HEY VACAY TRAVEL CONSULTANTS, LLC utilizes secure, encrypted payment processing systems designed to protect your financial information. Unless specifically authorized by you and permitted by applicable payment processing standards, HEY HEY VACAY TRAVEL CONSULTANTS, LLC does not retain your complete credit card information after payment has been processed. We take reasonable measures to safeguard the personal and financial information entrusted to us; however, no electronic transmission or data storage system can be guaranteed to be completely secure.

You agree not to dispute or initiate a chargeback for charges that you have authorized and that have been properly processed for travel services, supplier payments, or professional service fees performed by HEY HEY VACAY TRAVEL CONSULTANTS, LLC. Nothing in this Agreement limits your rights under applicable consumer protection laws regarding unauthorized or fraudulent transactions.

If a payment is declined, returned, reversed, disputed, or otherwise not honored by your financial institution or payment provider, HEY HEY VACAY TRAVEL CONSULTANTS, LLC reserves the right to suspend or discontinue work on your reservation until the payment issue has been fully resolved.

You acknowledge that a declined, delayed, or reversed payment may result in supplier-imposed cancellation penalties, loss of promotional pricing, forfeiture of deposits, cancellation of reservations, or loss of availability. HEY HEY VACAY TRAVEL CONSULTANTS, LLC shall not be responsible for any such losses resulting from unsuccessful or delayed payments.

If HEY HEY VACAY TRAVEL CONSULTANTS, LLC incurs bank fees, payment processing fees, collection costs, chargeback fees, or other administrative expenses resulting from a declined payment, returned payment, or an improper chargeback, HEY HEY VACAY TRAVEL CONSULTANTS, LLC reserves the right to recover those actual costs from the traveler to the extent permitted by applicable law.

You remain responsible for all amounts owed for services performed by HEY HEY VACAY TRAVEL CONSULTANTS, LLC, as well as any supplier-imposed fees or penalties resulting from failed, delayed, or reversed payments.

Credit Card Recommendation

Whenever possible, HEY HEY VACAY TRAVEL CONSULTANTS, LLC strongly recommends paying for travel using a major credit card.

Credit card companies may provide valuable consumer protections that are generally unavailable with cash, checks, debit cards, wire transfers, or other payment methods.

Depending upon your card issuer and applicable law, these protections may include assistance in situations involving supplier financial default, billing disputes, or unauthorized transactions.

The availability of these protections is determined solely by your financial institution and card issuer. HEY HEY VACAY TRAVEL CONSULTANTS, LLC makes no representation or guarantee regarding any benefits offered by your credit card provider.

Identification Requirements (Domestic U.S. Air Travel)

The Transportation Security Administration (TSA) requires travelers age 18 and older to present acceptable identification in order to board domestic commercial flights within the United States.

Beginning May 7, 2025, travelers flying domestically must present one of the following:

A REAL ID-compliant driver’s license or identification card;
A valid U.S. Passport or Passport Card;
A U.S. Military ID;
A Trusted Traveler Card (such as Global Entry, NEXUS, or SENTRI); or
Another form of identification accepted by the TSA.

The legal name on your airline reservation must exactly match the government-issued identification you present at the airport.

Failure to comply with TSA identification requirements may result in denied boarding, delays, missed flights, or other travel disruptions.

It is your responsibility to ensure you possess acceptable identification before travel.

Passports, Visas & Travel Documentation

International travel generally requires a valid passport.

Many countries require that your passport remain valid for at least six (6) months beyond your scheduled return date, and some countries require one or more blank passport pages for entry.

Depending upon your citizenship, destination, and itinerary, additional documentation may also be required, including:

Entry visas
Electronic Travel Authorizations (ETA)
Electronic System for Travel Authorization (ESTA)
European Travel Information and Authorization System (ETIAS), when applicable
Vaccination or health certificates
Proof of onward or return travel
Proof of sufficient financial resources
Other documentation required by destination or transit countries

It is solely your responsibility to obtain, maintain, and present all required travel documentation before departure.

Failure to possess the required documentation may result in denied boarding, denied entry, quarantine, deportation, cancellation of travel services, additional expenses, or other travel disruptions for which HEY HEY VACAY TRAVEL CONSULTANTS, LLC shall not be responsible.

Official travel documentation and entry requirements may be obtained through:

U.S. Department of State – https://travel.state.gov
The embassy or consulate of each destination and transit country
Official government immigration websites for your destination(s)

Non-U.S. citizens are responsible for determining the documentation and entry requirements applicable to their nationality.

Criminal Record, Immigration & Admissibility

Every country has the sovereign authority to determine who may enter or transit through its borders.

Certain countries—including, but not limited to, Canada—may deny entry to travelers with criminal histories. Depending upon the destination country’s laws, this may include felony convictions, misdemeanor convictions, DUI/DWI offenses, pending criminal charges, deferred adjudication, diversion programs, or other criminal matters.

Because immigration laws vary by country and frequently change, HEY HEY VACAY TRAVEL CONSULTANTS, LLC cannot determine whether you will be legally admissible to any destination.

It is solely your responsibility to determine your eligibility to enter, transit through, or depart from every country included in your itinerary.

If you have ever:

Been arrested;
Been charged with a criminal offense;
Been convicted of a crime;
Entered a plea of guilty or no contest;
Received deferred adjudication;
Participated in a diversion program; or
Have any concern regarding your admissibility,

you should contact the embassy or consulate of each destination and transit country well before booking or traveling.

Health Requirements

Health, medical, and entry requirements vary by destination and may change without notice.

You are solely responsible for determining and satisfying all health-related travel requirements applicable to your itinerary, including but not limited to:

Vaccinations
Immunizations
Medical examinations
Health declarations
Travel health insurance requirements
Prescription medication regulations
Entry screening requirements
Public health measures
Other health documentation required by destination or transit countries

If you have medical conditions, mobility concerns, dietary restrictions, allergies, or other special needs that may affect your travel, you agree to notify HEY HEY VACAY TRAVEL CONSULTANTS, LLC before booking so that we may communicate your requests to travel suppliers whenever reasonably possible.

While HEY HEY VACAY TRAVEL CONSULTANTS, LLC will make reasonable efforts to communicate special requests, we cannot guarantee that any supplier will be able to accommodate them.

Travel Insurance

HEY HEY VACAY TRAVEL CONSULTANTS, LLC strongly recommends the purchase of comprehensive travel insurance for every traveler.

Travel insurance may provide valuable protection for unforeseen events, including but not limited to:

Trip cancellation
Trip interruption
Travel delays
Missed connections
Emergency medical treatment
Emergency medical evacuation
Lost, stolen, or delayed baggage
Supplier financial default (where covered)
Weather-related disruptions
Other covered unforeseen events

Travel insurance policies vary significantly in coverage, exclusions, conditions, limitations, and claim requirements. You are responsible for reviewing any policy offered to determine whether it meets your individual needs.

If you decline travel insurance, you acknowledge that you may be personally responsible for cancellation penalties, supplier fees, medical expenses, emergency evacuation costs, travel delays, supplier defaults, and other financial losses that might otherwise have been covered.

Unless specifically stated otherwise, HEY HEY VACAY TRAVEL CONSULTANTS, LLC is not an insurance company and does not determine insurance coverage, interpret policy language, or decide claim eligibility. All coverage determinations and claims decisions are made solely by the insurance provider under the terms of the applicable policy.

Supplier Cancellations, Refunds & Future Travel Credits

Cancellation policies, refund eligibility, future travel credits, travel vouchers, and supplier compensation are established solely by the individual travel supplier.

Each airline, cruise line, hotel, resort, tour operator, transportation company, insurance provider, and other supplier maintains its own policies, which may change without notice.

HEY HEY VACAY TRAVEL CONSULTANTS, LLC has no authority to waive, modify, override, or guarantee supplier policies, refunds, credits, exceptions, or compensation.

If HEY HEY VACAY TRAVEL CONSULTANTS, LLC assists you in requesting refunds, credits, exceptions, or other accommodations from a supplier, such assistance is provided as a professional service and does not constitute a guarantee that the supplier will approve the request.

Electronic Communications

You consent to receiving communications, invoices, confirmations, itineraries, travel documents, supplier notices, travel alerts, payment requests, and other information electronically.

Electronic communications may be delivered through:

Email
Secure client portals
Electronic signature platforms
Secure payment systems
Text messages (when authorized)
Other electronic communication methods

Electronic communications shall be deemed received when transmitted to the contact information you have provided.

You are responsible for maintaining current contact information with HEY HEY VACAY TRAVEL CONSULTANTS, LLC throughout the planning process and during your travels.

Client Responsibility for Communication & Timely Response

Providing exceptional travel service requires timely communication between you and HEY HEY VACAY TRAVEL CONSULTANTS, LLC.

You agree to:

Regularly monitor your email, including spam, junk, promotions, and clutter folders.
Maintain current contact information with HEY HEY VACAY TRAVEL CONSULTANTS, LLC.
Review all travel documents and communications promptly.
Respond to requests for information or approvals in a timely manner.
Meet all supplier deadlines, including payments, online check-in, passport submissions, visa applications, travel authorizations, seat selections, and other required actions.

Although HEY HEY VACAY TRAVEL CONSULTANTS, LLC makes every reasonable effort to remind clients of important deadlines, you acknowledge that the ultimate responsibility for reviewing communications and meeting those deadlines remains yours.

Failure to respond or provide requested information may result in reservation cancellations, supplier penalties, denied boarding, denied entry, additional expenses, or other travel disruptions.

HEY HEY VACAY TRAVEL CONSULTANTS, LLC shall not be liable for losses resulting from your failure to review communications, respond promptly, provide requested information, or satisfy supplier deadlines.

If additional work becomes necessary because of delayed responses, missed deadlines, incomplete information, or failure to follow instructions, HEY HEY VACAY TRAVEL CONSULTANTS, LLC reserves the right to assess applicable Professional Service Fees.

Travel Advisor Authority During Time-Sensitive Situations

Travel suppliers occasionally require immediate decisions in order to preserve reservations or minimize travel disruptions.

Whenever practical, HEY HEY VACAY TRAVEL CONSULTANTS, LLC will make reasonable efforts to contact you before taking action.

However, if immediate action is required and you cannot be reached after reasonable attempts, you authorize HEY HEY VACAY TRAVEL CONSULTANTS, LLC, using its professional judgment, to take reasonable actions intended to protect your travel arrangements.

Such actions may include:

Accepting airline schedule changes.
Confirming alternative flights.
Protecting existing reservations.
Accepting comparable accommodations.
Communicating with suppliers on your behalf.
Reconfirming travel arrangements.
Taking other reasonable actions intended to minimize disruption.

This authorization does not permit HEY HEY VACAY TRAVEL CONSULTANTS, LLC to purchase substantially different travel arrangements or incur significant additional expenses without your approval whenever obtaining that approval is reasonably possible.

Any supplier-imposed costs, fare differences, upgrade charges, taxes, penalties, or additional expenses remain your responsibility unless otherwise covered by the supplier or an applicable travel insurance policy.

Actions taken by HEY HEY VACAY TRAVEL CONSULTANTS, LLC in good faith under this authorization shall not create liability for HEY HEY VACAY TRAVEL CONSULTANTS, LLC.

Name Accuracy

Many travel suppliers require that each traveler’s name exactly match the government-issued identification that will be presented during travel.

You are solely responsible for providing complete and accurate traveler information.

Any supplier fees, fare increases, reservation cancellations, denied boarding, denied entry, or other losses resulting from inaccurate traveler information are your responsibility.

Although HEY HEY VACAY TRAVEL CONSULTANTS, LLC will make reasonable efforts to identify obvious discrepancies, verification of traveler information ultimately remains your responsibility.

Limitation of Liability

To the fullest extent permitted by applicable law, HEY HEY VACAY TRAVEL CONSULTANTS, LLC shall not be liable for any injury, illness, death, property damage, theft, delay, inconvenience, cancellation, financial loss, emotional distress, lost profits, incidental damages, consequential damages, or punitive damages arising from or relating to:

Acts or omissions of travel suppliers;
Government actions or regulations;
Immigration decisions;
Denied boarding or denied entry;
Force Majeure Events;
Criminal acts of third parties;
Mechanical failures;
Transportation delays or schedule changes;
Supplier bankruptcy or financial insolvency;
Travel documentation deficiencies;
Criminal inadmissibility;
Health-related travel restrictions; or
Any event beyond the reasonable control of HEY HEY VACAY TRAVEL CONSULTANTS, LLC.

To the extent liability is established, the maximum liability of HEY HEY VACAY TRAVEL CONSULTANTS, LLC shall not exceed the total amount of professional service fees actually paid directly to HEY HEY VACAY TRAVEL CONSULTANTS, LLC for the specific travel arrangements giving rise to the claim.

Nothing in this Agreement is intended to waive, limit, or modify any rights that cannot legally be waived under applicable law.

Governing Law, Venue & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the state in which HEY HEY VACAY TRAVEL CONSULTANTS, LLC maintains its principal place of business, without regard to its conflict of law principles.

The parties agree to make a good-faith effort to resolve any dispute, claim, or controversy arising out of or relating to this Agreement through direct communication before initiating legal proceedings.

If a dispute cannot be resolved informally, and unless otherwise required by applicable law, any legal action arising out of or relating to this Agreement shall be brought exclusively in a state or federal court of competent jurisdiction located in the state in which HEY HEY VACAY TRAVEL CONSULTANTS, LLC maintains its principal place of business. Each party consents to the personal jurisdiction and venue of those courts.

If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect.

To the extent permitted by applicable law, the prevailing party in any legal action or proceeding arising out of or relating to this Agreement shall be entitled to recover its reasonable attorneys’ fees, court costs, and other litigation expenses from the non-prevailing party, as determined by the court.

Nothing in this section limits any rights or remedies that cannot legally be waived or modified under applicable federal, state, or local law.

Acceptance of Terms

By signing this Agreement, electronically accepting these Terms and Conditions, authorizing payment, or instructing HEY HEY VACAY TRAVEL CONSULTANTS, LLC to arrange travel on your behalf, you acknowledge and agree that:

You have read and understand this Travel Services Agreement.
You have had the opportunity to ask questions before proceeding.
You agree to be bound by these Terms and Conditions.
You authorize HEY HEY VACAY TRAVEL CONSULTANTS, LLC to arrange travel on your behalf.
You understand that travel involves inherent risks.
You understand that travel suppliers establish their own terms, conditions, cancellation policies, and refund rules.
You accept responsibility for obtaining proper identification, passports, visas, travel authorizations, and determining your legal eligibility to travel.
You understand that HEY HEY VACAY TRAVEL CONSULTANTS, LLC has recommended travel insurance and that you have had the opportunity to purchase coverage.
You understand that Professional Service Fees may apply as outlined in this Agreement.

Electronic Signature and Acceptance

You acknowledge that your electronic signature, electronic acceptance of this Agreement, authorization of payment, or continued instruction for HEY HEY VACAY TRAVEL CONSULTANTS, LLC to arrange travel on your behalf shall constitute your legal acceptance of these Terms and Conditions.

You agree that electronic signatures, electronic records, and electronic communications shall have the same legal force and effect as original handwritten signatures to the fullest extent permitted by applicable law.

Entire Agreement; Modifications; No Waiver

This Travel Services Agreement and Terms and Conditions constitute the entire agreement between you and HEY HEY VACAY TRAVEL CONSULTANTS, LLC regarding the travel planning services, reservations, and related professional services described herein. This Agreement supersedes all prior or contemporaneous oral or written discussions, representations, understandings, proposals, or agreements relating to those services.

No amendment, modification, waiver, or exception to this Agreement shall be valid unless it is made in writing and expressly authorized by HEY HEY VACAY TRAVEL CONSULTANTS, LLC, except where otherwise required by applicable law.

If HEY HEY VACAY TRAVEL CONSULTANTS, LLC elects not to enforce any provision of this Agreement on one occasion, such decision shall not constitute a waiver of that provision or of the right to enforce that provision or any other provision in the future.

The section headings contained in this Agreement are provided solely for convenience and shall not affect the interpretation of any provision.

This Agreement shall be binding upon and shall inure to the benefit of the traveler(s), HEY HEY VACAY TRAVEL CONSULTANTS, LLC, and their respective successors, permitted assigns, heirs, and legal representatives, as applicable.
